All platform content, branding, design elements, software, logos, graphics, text, and other materials belonging to Cliicks, except user-generated content, are the property of Cliicks or its licensors and are protected by applicable intellectual property laws. كما توافقون على عدم تعطيل تشغيل المنصة، أو محاولة الوصول غير المصرح به، أو نشر برمجيات ضارة، أو استغلال خصائص المنصة بشكل يضر بها أو بالمستخدمين الآخرين.

5. محتوى المستخدم

يمكن للمستخدمين نشر أو رفع أو مشاركة أو إرسال محتوى عبر كليكس، بما في ذلك النصوص والصور ومقاطع الفيديو والتعليقات ومعلومات الملف الشخصي وغيرها من المواد. وتبقون أنتم مسؤولين عن المحتوى الذي تقومون بنشره، وعن التأكد من امتلاككم للحقوق اللازمة لاستخدامه ونشره.

ومن خلال نشر المحتوى على كليكس، فإنكم تمنحون المنصة ترخيصًا غير حصري ومحدودًا وقابلًا للإلغاء وعالمي النطاق لاستخدام هذا المحتوى واستضافته وتخزينه وعرضه ونسخه وتوزيعه، وذلك فقط بالقدر اللازم لتشغيل المنصة وتحسينها والترويج لخدماتها.

ونحتفظ بالحق في مراجعة أو إزالة أو تقييد أو رفض أي محتوى يخالف هذه الشروط والأحكام أو نرى بشكل معقول أنه غير مناسب أو ضار أو غير قانوني أو مسيء للمنصة أو لمستخدميها.

6. المحتوى والسلوك المحظور

لا يجوز استخدام كليكس لنشر أو مشاركة أي محتوى غير قانوني أو مسيء أو تشهيري أو فاضح أو مضلل أو احتيالي أو ينطوي على كراهية أو تمييز أو انتهاك للحقوق. كما يُحظر انتحال الشخصية، والرسائل المزعجة، وعمليات الاحتيال، والتصيد، والتحرش، والإعلانات غير المصرح بها، وأي إساءة استخدام للمنصة.

وأي محاولة لاستغلال المنصة أو إساءة استخدام خصائص المجتمع أو التلاعب بالتفاعل أو انتهاك حقوق الآخرين أو سلامتهم قد تؤدي إلى إزالة المحتوى أو تعليق الحساب أو إنهائه بشكل دائم.

7. الملكية الفكرية

جميع عناصر المنصة ومحتوياتها وعلاماتها التجارية وتصميمها وبرمجياتها وشعاراتها ورسوماتها ونصوصها وأي مواد أخرى مملوكة لكليكس، باستثناء المحتوى الذي ينشره المستخدمون، هي ملك للمنصة أو للجهات المرخصة لها، وتخضع للحماية بموجب قوانين الملكية الفكرية المعمول بها. ولا يجوز نسخ أو إعادة إنتاج أو توزيع أو تعديل أو إعادة نشر أو استغلال أي جزء من المنصة دون إذن كتابي مسبق، إلا في الحدود التي يسمح بها القانون.

8. الخصوصية

يخضع استخدامكم لمنصة كليكس أيضًا لسياسة الخصوصية الخاصة بنا. وباستخدامكم للمنصة، فإنكم تقرّون بإمكانية جمع بعض المعلومات ومعالجتها واستخدامها وفقًا لسياسة الخصوصية وآلية تشغيل الخدمة.

10. توفر المنصة

نحن نسعى إلى توفير وصول موثوق إلى كليكس، لكننا لا نضمن أن تكون الخدمة متاحة دون انقطاع أو خالية من الأخطاء. ويجوز لنا تعديل أو تعليق أو تقييد أو إيقاف أي جزء من المنصة بشكل مؤقت أو دائم، مع أو دون إشعار، إذا اقتضت الحاجة ذلك لأغراض الصيانة أو التحديث أو الأمان أو الامتثال القانوني أو الأسباب التشغيلية.

11. تعليق الحسابات وإنهاؤها

نحتفظ بالحق في تعليق أو تقييد أو إنهاء الوصول إلى كليكس وفقًا لتقديرنا إذا رأينا أن المستخدم قد خالف هذه الشروط والأحكام، أو ألحق ضررًا بالمنصة، أو عرّض المستخدمين الآخرين للخطر، أو تورط في سلوك غير قانوني أو مسيء. كما يجوز لنا إزالة الأسماء أو الملفات الشخصية أو المحتوى عند الضرورة.

12. إخلاء المسؤولية

يتم توفير كليكس على أساس “كما هي” و“كما هي متاحة”. ولا نقدم أي ضمانات صريحة أو ضمنية بشأن توفر المنصة أو موثوقيتها أو دقتها أو أمانها أو ملاءمتها لأي غرض معين. واستخدامكم للمنصة يكون على مسؤوليتكم الخاصة.

13. تحديد المسؤولية

إلى أقصى حد يسمح به القانون، لا تتحمل كليكس أو مالكوها أو مشغلوها أو شركاؤها أو موظفوها أو الجهات التابعة لها أي مسؤولية عن الأضرار غير المباشرة أو العرضية أو الخاصة أو التبعية أو العقابية، أو عن أي خسارة في البيانات أو السمعة أو الأرباح أو الفرص الناشئة عن استخدامكم للمنصة أو المرتبطة به.

14. التعويض

توافقون على تعويض كليكس والجهات التابعة لها وفريقها وشركائها وإبراء ذمتهم من أي مطالبات أو أضرار أو التزامات أو خسائر أو تكاليف أو مصروفات تنشأ عن استخدامكم للمنصة، أو عن المحتوى الذي تقدمونه، أو عن مخالفتكم لهذه الشروط، أو عن انتهاككم لحقوق أي طرف آخر.

15. التعديلات على الشروط

يجوز لنا تحديث أو تعديل هذه الشروط والأحكام من وقت لآخر. ويُعد استمراركم في استخدام كليكس بعد سريان أي تعديلات بمثابة موافقة على النسخة المحدثة من الشروط. وننصح المستخدمين بمراجعة هذه الصفحة بشكل دوري.

16. المبادئ النظامية

تُفسر هذه الشروط والأحكام وتُطبق وفقًا للأنظمة والقوانين المعمول بها. وإذا تبين أن أي بند من هذه الشروط غير صالح أو غير قابل للتنفيذ، فإن بقية البنود تبقى سارية ونافذة بالكامل.
